These Terms of Service are drafted in Lithuanian and are legally binding. By registering or using the Awarda service, you confirm that you have read, understood, and agree to these terms.

Terms of Service

Effective date: 22 July 2026

These Terms of Service (hereinafter – “Terms”) are established and applied by Malkovich MB, a legal entity registered under Lithuanian law (hereinafter – “we”, “us” or “Company”), operating the Awarda public procurement intelligence platform at www.awarda.eu (hereinafter – “Service”).

1. Definitions

  • Service – access to the Awarda web platform and its functionality, including automated EU public procurement notice search and suitability analysis.
  • User – any natural or legal person registered in the Service and having an account. A Consumer is a natural person acting for purposes outside that person's trade, business, craft, or profession.
  • Subscription – a paid or free Service usage plan under the rates specified in Section 4.
  • Content – all data, texts, reports, and other material that the Service generates or provides to the User.
  • Nothing in these Terms excludes or limits a Consumer's mandatory rights or any other right or liability that cannot lawfully be excluded or limited.

2. Account Creation and Use

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining account security and all activity carried out through your account. Immediately notify us of any unauthorised account use at support@awarda.eu.

The account is intended for use by a single company or organisation. It is prohibited to transfer, share, or otherwise grant access to the account to third parties without our prior written consent.

3. Service Description

Awarda automatically collects and processes publicly available EU public procurement notices from TED (Tenders Electronic Daily) and other official sources, and matches them to your company profile based on CPV codes, countries, and other criteria.

The Service purchased by the User under these Terms is access to the Awarda platform and its functionality. To the fullest extent permitted by law, the Service and information supplied through it are provided on an “as is” and “as available” basis. Information is reproduced or processed from official sources and may be inaccurate, incomplete, out of date, or unavailable. We do not guarantee the accuracy of any source website or domain, the completeness or timeliness of information, or uninterrupted availability of the Service.

For Consumers, the Service remains subject to all mandatory digital-service conformity requirements and statutory remedies that apply to it. Nothing in these Terms excludes or limits those rights, including bringing the Service into conformity, a price reduction, termination, reimbursement, or any other remedy required by applicable law.

Awarda does not guarantee that a User will qualify for any tender, be invited to participate, win any tender, or achieve any particular business result. The User must independently check the original official source before deciding whether to participate in a procurement procedure or submit a bid. The User is solely responsible for eligibility and bid decisions.

4. Subscription Plans and Payments

PlanPriceCPV codesNotice limit
Free€0 / mo.5—
Starter€29.90 / mo.5Unlimited
Growth€79.90 / mo.Unlimited500 / mo.

Payments are processed through the Stripe payment platform. By paying, you agree to Stripe's terms of service. We do not store payment card data.

Paid subscriptions automatically renew each month until cancelled. An invoice is issued at the beginning of each billing period.

Total price and taxes. The order-review page shows the selected subscription price and Stripe calculates the final total inclusive of applicable VAT from your billing address. Stripe shows that tax-inclusive total before you place the payment order. No payment order is placed on Awarda's order-review page.

5. Paid subscription

A paid Starter or Growth plan activates only after payment is confirmed in Stripe Checkout. Before confirmation, the price, applicable VAT, and automatic renewal price are shown clearly. You can cancel before the next renewal.

6. Cancellation and Refunds

You may cancel your subscription at any time via the “Plan & Billing” section in your account settings. Upon cancellation, the subscription remains active until the end of the current billing period — access is not terminated immediately.

Refund policy. Given the nature of the digital service, prepaid fees, including prepaid subscription fees, are non-refundable, except where a refund or reimbursement is required by applicable law, including a Consumer's withdrawal rights, mandatory digital-service remedies, or rights arising from our breach. No discretionary refunds are offered. This policy does not limit any statutory right to repair or re-performance, a price reduction, termination, reimbursement, damages, or another remedy that cannot lawfully be excluded.

We reserve the right to suspend or terminate an account for a User's material violation of these Terms, subject to any notice, cure, refund, reimbursement, or other rights required by applicable law. This does not remove a Consumer's mandatory rights or any right to compensation or refund that cannot lawfully be excluded.

Consumer withdrawal and immediate supply

If you are a Consumer, you normally have 14 days from conclusion of the subscription contract to withdraw without giving a reason, subject to applicable law. To exercise that right, send an unambiguous statement identifying your account and decision to withdraw to support@awarda.eu. We will acknowledge the request and make any reimbursement required by law using the original payment method unless otherwise agreed.

Before Checkout, you must separately request immediate supply of the digital service during that period, acknowledge the consequences explained to you, and agree to receive confirmation on a durable medium. Immediate access does not remove any withdrawal, conformity, refund, price-reduction, termination, or other mandatory remedy except to the extent applicable law permits after the required request, consent, acknowledgement, confirmation, and performance.

7. AI Features

The Service offers optional features using artificial intelligence (AI) technologies: automatic notice summaries, bid participation checklists, and similar recommendations. By using these features, you agree to the following limitations:

  • AI-generated summaries are based only on publicly available notice fields (title, buyer, CPV codes, deadlines, value). They do not constitute legal advice and do not represent the full content of the notice documents.
  • AI outputs may be inaccurate, incomplete, or outdated. Always review the original notice before submitting any bid.
  • AI features require a paid subscription (Starter or Growth).
  • We assume no liability for decisions made on the basis of AI-generated content.

8. Intellectual Property

The entire platform, its design, code, marks, and original content are the intellectual property of Malkovich MB, protected by applicable copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal or business purposes within the scope of these Terms.

Public procurement notices received from TED and other government sources are publicly available data; we make no proprietary claim over them.

9. Prohibited Uses

In using the Service, you are prohibited from:

  • automatically extracting (scraping) Service data without our written consent;
  • using the Service for unlawful or unethical bid submissions;
  • distributing, reselling, or sublicensing access to the Service;
  • attempting to restrict, overload, or disrupt the Service;
  • fraudulently obtaining or using the trial period repeatedly with different email addresses.

10. Limitation of Liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without any express or implied warranties. We assume no liability for:

  • lost profits, business opportunities, or tenders due to Service errors or downtime;
  • inaccurate or incomplete information obtained from third-party sources (TED, national portals);
  • decisions made on the basis of AI-generated content;
  • Service unavailability due to force majeure circumstances.

Our total liability to you for any claim shall not exceed the amount you paid in the 3 (three) months preceding the claim. This limit does not apply to liability or mandatory remedies that cannot lawfully be excluded or limited, including a Consumer's statutory digital-service remedies, or liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or wilful misconduct.

11. Data Protection

The processing of personal data is described in our Privacy Policy. For business clients who are data controllers under GDPR, we can conclude a Data Processing Agreement (DPA) — contact us at support@awarda.eu.

12. Applicable Law and Dispute Resolution

These Terms are governed by the law of the Republic of Lithuania. If you are a Consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you have your habitual residence. A Consumer may bring proceedings in any court available under applicable EU or national law, including the courts of that country, and nothing in these Terms requires a Consumer to give up that right. We may bring proceedings against a Consumer only in a court permitted by applicable law.

Consumers may have rights under applicable national law to use a recognized alternative dispute resolution entity. The applicable entity and procedure depend on the consumer's country of residence. We do not direct consumers to the discontinued EU Online Dispute Resolution platform.

13. Changes to Terms

We may change these Terms only for a valid reason, such as a change in law, security requirement, technical development, or Service functionality. We will notify you of material changes by email or another durable medium, or by a clearly visible notice in the Service, no later than 14 days in advance, explaining the change and its reason. If a change negatively affects a Consumer's access to or use of the Service beyond a minor degree, the Consumer may terminate the affected subscription without an additional charge and receive any reimbursement required by applicable law. Continued use does not waive mandatory rights or, where applicable law requires consent, constitute the sole basis for accepting a change.
